  • Important Policies

    These policies apply to all photography services provided by Samy Kadous Media Co. By booking a service, submitting payment, or otherwise confirming a booking, the client acknowledges and agrees to these policies and the applicable service-specific Terms & Conditions below.

    Booking & Payment

    • A booking is not confirmed until the required payment has been received and the booking has been accepted by Samy Kadous Media Co.

    • Payment is required in full before the scheduled service unless otherwise agreed upon in writing.

    • Once a booking is confirmed, the scheduled time is reserved for the client and may prevent other bookings from being accepted.

    • Pricing may vary depending on the type, scope, location, and circumstances of the requested photography service. Any applicable price will be communicated before booking.

    Cancellations & Rescheduling

    • Clients are expected to provide as much notice as possible when cancelling or requesting to reschedule.

    • Cancellations, rescheduling, refunds, and retained payments are subject to the terms of the applicable photography service.

    • A failure to attend a scheduled service without prior notice may be treated as a cancellation.

    • Rescheduled sessions or coverage are subject to the photographer's availability and are not guaranteed.

    Weather & Uncontrollable Circumstances

    • Outdoor photography and sports coverage may be affected by weather, unsafe conditions, venue restrictions, schedule changes, or other circumstances outside the photographer's control.

    • When conditions make photography unsafe or impractical, Samy Kadous Media Co. may postpone or reschedule the service when reasonably possible.

    • For sports coverage, the photographer is not responsible for changes to game schedules, cancellations, delays, venue access, weather, lighting, or other circumstances controlled by the school, team, venue, officials, or organizers.

    Client & Athlete Responsibilities

    • Clients are responsible for arriving at the scheduled location on time and being prepared for the agreed-upon service.

    • Late arrival does not automatically extend the scheduled service and may result in reduced coverage.

    • For sports photography, the photographer does not control an athlete's playing time, participation, position, performance, or opportunities during a game.

    • The photographer cannot guarantee that a particular athlete, play, moment, pose, or image will be captured.

    Photography & Image Delivery

    • Samy Kadous Media Co. retains creative discretion over photographic coverage and the selection and editing of delivered images.

    • Not every photograph taken during a service will be delivered.

    • RAW files, unedited images, rejected images, and working files are not included unless specifically agreed upon in writing.

    • Delivery timeframes may vary depending on the type and volume of coverage.

    • Additional editing or retouching requests outside the photographer's standard editing process may be subject to additional charges.

    Copyright & Image Use

    • Photographs remain the intellectual property of Samy Kadous Media Co. unless otherwise agreed upon in writing.

    • Purchasing photography services does not transfer copyright ownership to the client.

    • Clients may use delivered photographs only within the usage rights provided by the applicable agreement.

    • Commercial use, resale, licensing, or redistribution outside the permitted use requires prior written permission.

    Service-Specific Terms

    The Senior Sessions and Sports Game Action Coverage sections below contain additional terms specific to those services. Where a service-specific term applies, that term governs the applicable booking.

    The full Terms & Conditions constitute the complete agreement between the client and Samy Kadous Media Co. regarding the applicable photography service.

  • Senior Photography Session Terms & Conditions

    These Senior Photography Session Terms & Conditions ("Terms") establish the policies and conditions applicable to senior photography sessions provided by SAMY KADOUS MEDIA CO. ("SAMY KADOUS MEDIA CO.," "I," "me," or "my").

    By requesting, scheduling, or booking a senior photography session and submitting the required retainer, the client ("Client," "you," or "your") acknowledges that they have had an opportunity to review these Terms and agrees to be bound by them.

    These Terms are intended to provide clear expectations regarding pricing, payment, scheduling, cancellation, rescheduling, travel, locations, image delivery, and other matters relating to senior photography sessions.

    1. Session Packages and Pricing

    SAMY KADOUS MEDIA CO. currently offers the following senior photography packages:

    • Mini Session — $125

    • Essential Session — $200

    • Signature Session — $300

    • Premium Session — $450

    The specific services, session duration, number of locations, outfit changes, number of delivered images, and other inclusions associated with each package are listed on the Senior Sessions page of the SAMY KADOUS MEDIA CO. website.

    Package details and pricing may be changed for future bookings. Any pricing or package changes will not affect a session that has already been confirmed unless otherwise agreed upon by both the Client and SAMY KADOUS MEDIA CO.

    Additional services, expenses, or fees that are not specifically included in the selected package may be charged separately as described in these Terms.

    2. Booking and Reservation of Session Date

    A session date and time are not considered reserved until the required retainer has been paid and the booking has been confirmed by SAMY KADOUS MEDIA CO.

    A request, inquiry, or discussion regarding a particular date does not guarantee availability or reserve that date.

    The Client must submit the required retainer in order to secure a session date and have the session placed on the photographer's calendar.

    If the retainer has not been received, SAMY KADOUS MEDIA CO. may offer the requested date and time to another client without prior notice.

    3. Retainer

    A retainer equal to 50% of the selected package price is required at the time of booking.

    The current retainer amounts are:

    • Mini Session — $62.50

    • Essential Session — $100

    • Signature Session — $150

    • Premium Session — $225

    The retainer is applied toward the total package price and is not an additional charge.

    The retainer is non-refundable, except where a refund is specifically required under these Terms or otherwise agreed upon in writing by SAMY KADOUS MEDIA CO.

    Payment of the retainer represents the Client's commitment to the reserved date and compensates SAMY KADOUS MEDIA CO. for reserving that date and declining other potential bookings for the same period.

    4. Remaining Balance

    The remaining balance may be paid at any time after the booking has been confirmed.

    The full remaining balance must be received before the scheduled session begins.

    SAMY KADOUS MEDIA CO. will not be required to begin or complete a session for which the required balance has not been paid.

    Accepted payment methods include:

    • Cash

    • Venmo

    • Credit or debit card

    Any applicable payment processing fees, if disclosed to the Client before payment, may be charged in addition to the listed session price.

    5. Cancellation by Client

    If the Client chooses to cancel a scheduled session, the retainer will not be refunded.

    Cancellation includes, but is not limited to, cancellation due to scheduling conflicts, changes in plans, personal circumstances, transportation issues, dissatisfaction with the selected location, or any other reason initiated by the Client.

    If the Client has paid amounts in addition to the non-refundable retainer, SAMY KADOUS MEDIA CO. will determine whether those additional amounts are refundable based on the circumstances and timing of the cancellation.

    A Client should contact SAMY KADOUS MEDIA CO. as soon as possible if they need to cancel or change a booking.

    6. Rescheduling by Client

    The Client may request to reschedule a session one time without forfeiting the retainer, provided that the request is made at least five (5) days before the scheduled session date.

    The new date is subject to SAMY KADOUS MEDIA CO.'s availability.

    A rescheduled session remains subject to these Terms.

    Requests to reschedule made fewer than five (5) days before the scheduled session may be treated as a cancellation, resulting in forfeiture of the retainer.

    Once a Client has used their one permitted reschedule, any additional request to change the session date may be treated as a cancellation and may require payment of a new retainer in order to schedule another session.

    7. Weather-Related Rescheduling

    For outdoor sessions, weather conditions may affect the ability to safely and reasonably conduct the session.

    SAMY KADOUS MEDIA CO. will make the final determination as to whether weather conditions are suitable for the session. Factors may include rain, thunderstorms, lightning, excessive wind, extreme temperatures, unsafe travel conditions, or other conditions that could negatively affect the safety or quality of the session.

    If SAMY KADOUS MEDIA CO. determines that the session should be postponed because of weather, the session may be rescheduled at no additional charge.

    A weather-related rescheduling initiated by SAMY KADOUS MEDIA CO. will not count as the Client's one permitted reschedule.

    If weather conditions are questionable, SAMY KADOUS MEDIA CO. may communicate with the Client before the scheduled session to determine whether the session should proceed.

    8. Cancellation or Rescheduling by SAMY KADOUS MEDIA CO.

    SAMY KADOUS MEDIA CO. reserves the right to cancel or reschedule a session when circumstances prevent the session from being reasonably or safely completed.

    Such circumstances may include illness, emergency, severe weather, unsafe conditions, equipment failure, or other circumstances outside of the photographer's reasonable control.

    If SAMY KADOUS MEDIA CO. cancels or reschedules a session, the Client will be offered the opportunity to select another available date without an additional rescheduling fee.

    If SAMY KADOUS MEDIA CO. is unable to provide the session and a mutually acceptable replacement date cannot be arranged, payments made toward the session will be refunded.

    9. Travel

    Travel within a 25-mile radius of Mooresville, North Carolina is included in the listed session price.

    For locations outside of the included 25-mile radius, a travel fee of $0.75 per mile beyond the included radius, calculated using the round-trip distance, may apply.

    Any applicable travel fee will be communicated to the Client before the location is finalized.

    The Client is also responsible for any additional transportation-related costs that are directly required by the selected location or route, including tolls, parking charges, or other mandatory fees.

    Travel fees are separate from location admission, permit, or photography fees.

    10. Location Fees and Requirements

    The Client is responsible for all costs associated with accessing or photographing at the selected session location unless SAMY KADOUS MEDIA CO. has expressly agreed otherwise in writing.

    These costs may include, but are not limited to:

    • General admission

    • Professional photography fees

    • Photography permits

    • Location rental fees

    • Property fees

    • Parking fees

    • Reservations

    • Photographer or vendor passes

    • Entrance fees

    • Facility fees

    • Other fees imposed by the property or venue

    For example, if a flower field, garden, park, venue, private property, or other location requires payment for admission or professional photography, those costs are the responsibility of the Client and are not included in the listed session price.

    The Client is responsible for informing SAMY KADOUS MEDIA CO. of any known location requirements before the session.

    The Client should confirm that professional photography is permitted at a location before selecting it for a session. SAMY KADOUS MEDIA CO. is not responsible for a location refusing access, requiring an unexpected fee, or prohibiting professional photography.

    If a location requires a permit or other authorization that has not been obtained, SAMY KADOUS MEDIA CO. may decline to photograph at that location.

    11. Location Changes

    Once a session location has been agreed upon, changing the location may result in additional travel fees or other costs.

    If a Client requests a location change shortly before the session, SAMY KADOUS MEDIA CO. may not be able to accommodate the request depending on scheduling, travel requirements, or location availability.

    Any additional fees resulting from a Client-requested location change are the responsibility of the Client.

    12. Arrival and Punctuality

    The Client is expected to arrive at the agreed-upon location at or before the scheduled start time.

    The scheduled session time begins at the agreed-upon start time regardless of when the Client arrives.

    Late arrival may reduce the amount of time available for photography. SAMY KADOUS MEDIA CO. is not required to extend the session beyond its scheduled end time because of a Client's late arrival.

    An arrival more than 30 minutes after the scheduled start time may be considered a no-show.

    If the Client's late arrival causes the session to become impractical or impossible to complete, the session may be ended and the retainer will be forfeited.

    13. No-Show

    A Client who does not appear for a scheduled session without an approved rescheduling arrangement will be considered a no-show.

    The retainer will be forfeited.

    SAMY KADOUS MEDIA CO. is not required to provide a replacement session following a no-show.

    A new booking may be considered at the photographer's discretion and may require a new retainer.

    14. Client and Guest Conduct

    The Client is responsible for their own conduct and the conduct of any guests they bring to the session.

    SAMY KADOUS MEDIA CO. reserves the right to end a session if the Client or a guest engages in behavior that is threatening, abusive, discriminatory, harassing, excessively disruptive, unsafe, or otherwise inappropriate.

    A session may also be ended if a Client or guest interferes with the photographer's ability to perform the agreed services or creates a safety risk to the Client, photographer, equipment, or another person.

    If a session is ended because of Client or guest conduct, the Client may be responsible for the full session price and will not be entitled to a refund of the retainer.

    15. Image Selection

    SAMY KADOUS MEDIA CO. retains discretion over the photographs selected for final delivery.

    Not every photograph taken during a session will be delivered to the Client.

    Images may be excluded from the final gallery because of technical issues, duplicates, test shots, unflattering expressions, closed eyes, focus issues, lighting issues, or other artistic or technical considerations.

    The Client does not receive every photograph taken during the session.

    16. Editing

    Final photographs will be edited according to the established style of SAMY KADOUS MEDIA CO.

    Editing may include adjustments to exposure, color, contrast, cropping, lighting, skin appearance, and other standard photographic adjustments.

    SAMY KADOUS MEDIA CO. retains artistic discretion regarding the final appearance of delivered photographs.

    Requests for extensive alterations, major body modifications, removal of permanent physical characteristics, replacement of backgrounds, changes to clothing, or other edits outside the photographer's normal editing process may be declined or may be subject to an additional fee if agreed upon in advance.

    17. RAW and Unedited Files

    RAW files, unedited files, rejected images, test images, and unfinished photographs are not provided to the Client.

    The Client will receive only the final edited photographs selected for delivery by SAMY KADOUS MEDIA CO.

    18. Image Delivery

    Final photographs will be delivered through the online gallery or other digital delivery method selected by SAMY KADOUS MEDIA CO.

    The Client is responsible for downloading and safely storing their delivered photographs.

    SAMY KADOUS MEDIA CO. is not required to maintain permanent access to a Client's gallery or permanently archive delivered files.

    Clients are encouraged to maintain their own backup copies of delivered photographs.

    19. Personal-Use License

    The Client receives a non-exclusive license to use the final delivered photographs for personal, non-commercial purposes.

    Personal use may include downloading, storing, printing, and sharing the photographs on personal social media accounts.

    The Client may not sell, license, commercially distribute, or otherwise use the photographs for commercial purposes without written permission from SAMY KADOUS MEDIA CO.

    The Client may not use the photographs in a manner that falsely implies endorsement, sponsorship, or affiliation with a business, organization, product, or service.

    20. Copyright

    Copyright and ownership of the photographs remain with Samy Kadous / SAMY KADOUS MEDIA CO.

    Payment for a photography session does not transfer copyright ownership to the Client.

    The personal-use rights described in these Terms do not constitute a transfer of copyright.

    21. Portfolio and Promotional Use

    SAMY KADOUS MEDIA CO. may request permission from the Client to use photographs from their session for portfolio, website, social media, advertising, promotional materials, competitions, or other business-related purposes.

    Permission will be requested separately from the booking process.

    The Client may decline permission for promotional use.

    Declining promotional use will not affect the Client's session, package, pricing, or access to their photographs.

    22. Personal Property

    The Client is responsible for personal belongings brought to the session, including clothing, accessories, phones, bags, vehicles, and other property.

    SAMY KADOUS MEDIA CO. is not responsible for lost, stolen, or damaged personal property.

    The Client is responsible for determining whether clothing, footwear, or personal items are appropriate for the selected location and conditions.

    23. Minors

    Senior photography clients may be under the age of 18.

    When required, a parent or legal guardian must provide authorization for the minor Client to participate in the session and may be required to acknowledge applicable terms on the minor's behalf.

    SAMY KADOUS MEDIA CO. may request parent or legal guardian contact information or authorization before completing a booking for a minor.

    24. Force Majeure and Unavoidable Circumstances

    SAMY KADOUS MEDIA CO. will not be considered in breach of these Terms when performance is prevented or materially affected by circumstances beyond reasonable control.

    Such circumstances may include severe weather, natural disasters, government restrictions, venue closures, transportation disruptions, emergencies, illness, injury, or other circumstances that make the session unsafe or impractical.

    When reasonably possible, SAMY KADOUS MEDIA CO. will attempt to reschedule the affected session.

    25. Changes to These Terms

    SAMY KADOUS MEDIA CO. may update these Terms from time to time.

    The Terms applicable to a booking are generally the Terms presented to the Client at the time of booking.

    Changes to these Terms will not retroactively alter a confirmed booking unless required by law or otherwise agreed upon by the Client and SAMY KADOUS MEDIA CO.

    26. Acceptance

    By submitting the required retainer and booking a senior photography session with SAMY KADOUS MEDIA CO., the Client acknowledges that they have read, understood, and agreed to these Senior Photography Session Terms & Conditions.

    The Client's payment of the required retainer constitutes confirmation that they accept the policies applicable to their booking.

    These Sports Game Action Photography Terms & Conditions ("Terms") apply to photography services provided by Samy Kadous, operating as SAMY KADOUS MEDIA CO. ("SAMY KADOUS MEDIA CO.," "I," "me," or "my").

    These Terms apply to individual athlete coverage, team coverage, game coverage, tournament coverage, and other sports photography services where SAMY KADOUS MEDIA CO. is hired to attend an athletic event and photograph one or more athletes.

    By requesting coverage, confirming a booking, or submitting payment for photography services, the Client ("Client," "you," or "your") acknowledges that they have reviewed these Terms and agree to the policies stated below.

    1. Nature of the Service

    Sports game-action photography is a photography service based on the photographer's time, travel, availability, and reasonable professional effort to document an athletic event.

    The Client is not purchasing a guaranteed number of photographs or a guaranteed amount of playing-time coverage.

    SAMY KADOUS MEDIA CO. will make a reasonable effort to photograph the requested athlete or athletes throughout the scheduled event and, when permitted, during warmups, introductions, pregame activities, and other appropriate portions of the event.

    Because athletic events are unpredictable and the photographer does not control the athlete, team, coaches, officials, venue, or event circumstances, certain photographs or moments cannot be guaranteed.

    2. Game Time, Playing Time, and Athlete Participation

    The Client acknowledges that playing time is completely outside of the photographer's control.

    SAMY KADOUS MEDIA CO. does not control whether an athlete starts, plays, is substituted, is benched, is injured, is suspended, is ejected, is sick, or otherwise participates in the event.

    SAMY KADOUS MEDIA CO. also does not control where an athlete is positioned, how often an athlete is involved in play, the pace of the game, coaching decisions, substitutions, or whether a particular play occurs while the photographer has a usable view.

    For these reasons, no minimum number of photographs, game-action photographs, plays, minutes of coverage, or photographs of a particular athlete is guaranteed.

    SAMY KADOUS MEDIA CO. will make a reasonable effort to photograph the requested athlete when opportunities are available.

    When permitted, the photographer may also photograph the athlete during warmups, introductions, pregame activities, and other appropriate moments when the athlete is not actively competing.

    An athlete receiving limited or no playing time does not constitute a failure to provide the contracted photography service and does not automatically entitle the Client to a refund.

    An athlete being injured, benched, suspended, ejected, substituted out, sick, or otherwise unable to participate likewise does not automatically entitle the Client to a refund.

    The Client is paying for the photographer's attendance and professional effort to cover the event, not for guaranteed playing time or a guaranteed number of photographs of the athlete.

    3. Game Duration and Coverage Time

    Coverage is based on the scheduled sporting event and the photographer's agreed availability.

    The standard service does not guarantee coverage for a specific number of photographs.

    If a game goes into overtime or is extended beyond its normal scheduled duration, SAMY KADOUS MEDIA CO. will make a reasonable effort to continue coverage when practical and safe.

    Additional games, doubleheaders, tournament rounds, practices, or events not included in the original booking may require additional payment.

    Any additional coverage requested by the Client may be quoted separately.

    4. Pricing

    Individual athlete game coverage starts at $50.

    Whole-team coverage starts at $250.

    Actual pricing is determined by SAMY KADOUS MEDIA CO. and may vary based on factors including the level of competition, type of event, location, expected duration, number of athletes, number of games, travel requirements, tournament structure, and other circumstances.

    Discounts may be available when multiple athletes from the same event or team are booked together.

    Any applicable discount is discretionary and will be communicated to the Client before payment.

    The price communicated to the Client and accepted before booking is the price that applies to that booking.

    5. Booking and Payment

    Sports photography bookings are handled directly between the Client and Samy Kadous.

    An inquiry or interest form does not constitute a booking.

    A date and event are considered officially booked only after the requested coverage has been accepted by SAMY KADOUS MEDIA CO. and payment has been received in full.

    Payment in full reserves the photographer's availability on the calendar for the specified event.

    Until payment has been received, SAMY KADOUS MEDIA CO. is not required to reserve the requested date or time.

    Accepted payment methods may include cash, Venmo, and credit or debit card.

    6. Advance Notice

    Clients are requested to provide at least seven (7) days' notice when requesting sports event coverage.

    Requests made with fewer than seven days' notice may be accepted at the discretion of SAMY KADOUS MEDIA CO. based on availability.

    Acceptance of a short-notice booking does not create an obligation to accept future short-notice bookings.

    7. Event Information

    The Client is responsible for providing accurate event information, including the athlete's name, sport, team, event date, scheduled start time, venue, venue address, jersey number, and any relevant access or photography restrictions.

    If the Client provides incorrect information regarding the date, time, location, venue, or other material event details, the Client is responsible for the resulting consequences.

    If SAMY KADOUS MEDIA CO. travels to the wrong time or location because of incorrect information provided by the Client, the Client remains responsible for the payment.

    SAMY KADOUS MEDIA CO. is not responsible for errors in information supplied by the Client.

    8. Schedule Changes

    The Client is responsible for communicating known schedule changes as soon as reasonably possible.

    A game time change of one (1) hour or less will generally be accommodated provided that the photographer remains available.

    A change of more than one hour may not be accommodated.

    Clients should provide at least five (5) days' notice of known schedule changes whenever reasonably possible.

    If an event is moved by more than one hour and adequate notice is not provided, and SAMY KADOUS MEDIA CO. is unable to accommodate the new time, the original booking may be treated as canceled by the Client and the full payment may be retained.

    If SAMY KADOUS MEDIA CO. chooses to accommodate a significant last-minute schedule change, the original payment remains valid.

    9. Client Cancellation

    Cancellation requests should be made at least five (5) days before the scheduled event.

    A cancellation made fewer than five days before the scheduled event may result in forfeiture of the full payment.

    This includes cancellations resulting from scheduling conflicts, transportation issues, changes in plans, athlete availability, personal circumstances, or other reasons within the Client's control.

    SAMY KADOUS MEDIA CO. may make exceptions at its discretion, but no exception is guaranteed.

    10. Athlete Injury, Illness, Benching, Suspension, or Non-Participation

    The Client acknowledges that the photographer does not control whether an athlete participates in the event.

    If an athlete is injured, sick, benched, suspended, ejected, substituted out, or otherwise does not participate, the Client remains responsible for the booking unless SAMY KADOUS MEDIA CO. determines otherwise.

    The photographer may still provide coverage during warmups, introductions, pregame activities, and other appropriate opportunities.

    The photographer cannot create game-action photographs when an athlete is not participating.

    11. Event Cancellation or Postponement

    If the team, school, league, tournament organizer, venue, or other event authority officially cancels or postpones the event, SAMY KADOUS MEDIA CO. will generally attempt to transfer the booking to the rescheduled date.

    A rescheduled event may be covered at no additional photography fee if the new date is compatible with the photographer's availability.

    If the new date is incompatible with SAMY KADOUS MEDIA CO.'s availability, the Client may receive a refund of the payment for the canceled coverage.

    This policy applies to official event cancellations or postponements and does not apply to individual Client cancellations.

    12. Weather

    For outdoor events, SAMY KADOUS MEDIA CO. may evaluate weather conditions before and during the event.

    If the event officially proceeds, the photographer may continue coverage unless conditions become unsafe or photography becomes reasonably impractical.

    SAMY KADOUS MEDIA CO. may stop coverage or decline to travel when conditions create an unreasonable safety risk, including severe storms, lightning, flooding, dangerous winds, extreme temperatures, unsafe roads, or similar circumstances.

    If the event is officially canceled or postponed because of weather, the event will be handled under the Event Cancellation or Postponement section.

    Weather decisions regarding the photographer's own ability to safely travel to or photograph an event remain at the photographer's discretion.

    13. Venue Access and Photography Permissions

    The Client is responsible for determining whether independent or outside photographers are permitted at the event.

    The Client must notify SAMY KADOUS MEDIA CO. of known restrictions before booking whenever possible.

    If the venue, school, team, league, tournament, or event organizer requires a photographer credential, media pass, permit, admission ticket, vendor authorization, or other permission, the Client is responsible for obtaining or arranging the required authorization unless otherwise agreed upon in writing.

    If outside photography is not permitted, SAMY KADOUS MEDIA CO. will not photograph the event.

    If the Client failed to determine that photography was prohibited and SAMY KADOUS MEDIA CO. is denied access as a result, the Client remains responsible for the payment.

    14. Event Access Costs

    The Client is responsible for costs necessary for SAMY KADOUS MEDIA CO. to access the event, including, when applicable:

    • Admission

    • Parking

    • Tolls

    • Photography permits

    • Media passes

    • Photographer credentials

    • Vendor passes

    • Venue fees

    These expenses are separate from the photography fee unless specifically included in the quoted price.

    The Client is responsible for paying or arranging these costs in sufficient time for the photographer to attend the event.

    15. Travel Fees

    Travel within a 25-mile radius of Mooresville, North Carolina is included in the listed coverage price.

    For locations outside of the included 25-mile radius, a travel fee of $0.75 per mile beyond the included radius, calculated using the round-trip distance, may apply.

    Any applicable travel fee will be communicated to the Client before payment.

    The Client is also responsible for tolls, parking, and mandatory event-related transportation costs.

    16. Photographer Positioning and Access During the Game

    SAMY KADOUS MEDIA CO. will make a reasonable effort to obtain useful shooting positions and angles.

    The photographer does not guarantee access to the sideline, field, court, track, bench, designated media area, or any other particular position.

    The photographer must comply with venue rules, team rules, official instructions, safety requirements, and restrictions imposed by event personnel.

    Crowds, other photographers, officials, players, coaches, equipment, venue structures, weather, and other circumstances may obstruct the photographer's view or affect the quality or quantity of available photographs.

    17. Image Selection

    SAMY KADOUS MEDIA CO. retains discretion over the photographs selected for final delivery.

    Not every photograph taken during an event will be delivered.

    Photographs may be excluded because of missed focus, motion blur, exposure issues, obstruction, duplicates, unsuccessful plays, unflattering expressions, test images, accidental photographs, or other technical or artistic considerations.

    The Client is not entitled to all photographs taken during the event.

    18. Editing

    Final photographs will be edited according to the established style of SAMY KADOUS MEDIA CO.

    Editing may include adjustments to exposure, color, contrast, cropping, lighting, sharpness, skin appearance, and other standard photographic adjustments.

    SAMY KADOUS MEDIA CO. retains artistic discretion regarding the final appearance and selection of delivered photographs.

    Requests for extensive alterations or edits outside the photographer's normal editing process may be declined or may require an additional fee.

    19. RAW and Unedited Files

    RAW files, unedited files, rejected photographs, test images, and unfinished photographs are not provided to the Client.

    Only final edited photographs selected for delivery by SAMY KADOUS MEDIA CO. are provided.

    20. Image Delivery

    Final photographs will be delivered through an online gallery or another digital delivery method selected by SAMY KADOUS MEDIA CO.

    The Client is responsible for downloading and safely storing delivered photographs.

    SAMY KADOUS MEDIA CO. is not required to maintain permanent access to a Client's gallery or permanently archive delivered files.

    Unless a specific delivery deadline has been agreed upon in writing, no guaranteed turnaround time applies.

    21. Personal-Use Rights

    The Client receives a non-exclusive license to use delivered photographs for personal, non-commercial purposes.

    Personal use includes downloading, storing, printing, and posting the photographs to personal social media accounts.

    The Client may not sell, license, commercially distribute, or otherwise use the photographs for commercial purposes without written permission from SAMY KADOUS MEDIA CO.

    22. Recruiting and School-Related Use

    Personal athletic use may include reasonable use of delivered photographs for college recruiting profiles, recruiting materials, personal athletic websites, school applications, and similar purposes.

    Use by a school, athletic department, team, league, business, brand, sponsor, media organization, or other organization may require separate permission.

    23. Copyright

    Copyright and ownership of the photographs remain with Samy Kadous / SAMY KADOUS MEDIA CO.

    Payment for photography services does not transfer copyright ownership to the Client.

    The personal-use rights provided under these Terms do not constitute a transfer of copyright.

    24. Social Media

    Clients may share delivered photographs on personal social media platforms for personal purposes.

    Clients are asked to provide appropriate photo credit when sharing photographs, although credit is not required unless separately agreed.

    Clients may not remove or intentionally obscure copyright notices or other identifying information contained in a delivered image.

    25. Commercial and Organizational Use

    Commercial advertising, sponsorships, paid promotions, publication by businesses or organizations, media use, or other non-personal use requires written permission from SAMY KADOUS MEDIA CO.

    Additional licensing fees may apply depending on the intended use.

    26. Promotional Use by SAMY KADOUS MEDIA CO.

    SAMY KADOUS MEDIA CO. may request permission from the Client to use photographs for portfolio, website, social media, advertising, promotional materials, or other business-related purposes.

    Permission will be requested separately.

    The Client may decline promotional use without affecting the Client's booking or pricing.

    27. Equipment and Technical Issues

    SAMY KADOUS MEDIA CO. will use reasonable care and professional equipment when providing photography services.

    However, technical failures can occur, including equipment failure, memory card failure, battery failure, software errors, file corruption, or other unexpected problems.

    If a technical issue occurs, SAMY KADOUS MEDIA CO. will make reasonable efforts to preserve or recover available photographs.

    The photographer does not guarantee recovery of photographs affected by technical failure.

    To the maximum extent permitted by applicable law, SAMY KADOUS MEDIA CO.'s financial responsibility for failure to deliver photographs resulting solely from a technical failure will not exceed the amount actually paid for the affected photography service.

    28. Safety

    SAMY KADOUS MEDIA CO. may decline to photograph from any location that presents an unreasonable safety risk.

    The photographer is responsible for determining where it is reasonably safe and permitted to operate photographic equipment.

    SAMY KADOUS MEDIA CO. is not responsible for the Client's athletic participation, injuries occurring during the sporting event, coaching decisions, or other risks inherent to participation in the sport.

    The photographer is providing photography services and is not acting as a coach, trainer, medical provider, team official, or event supervisor.

    29. Conduct

    SAMY KADOUS MEDIA CO. reserves the right to discontinue services if the Client or an individual acting on the Client's behalf engages in threatening, abusive, harassing, discriminatory, or otherwise inappropriate conduct toward the photographer.

    The photographer may also leave an event if venue or event personnel require the photographer to leave or if remaining would create an unreasonable safety risk.

    If services are discontinued because of Client conduct, the Client may not be entitled to a refund.

    30. No-Show

    If the Client or requested athlete does not attend the scheduled event and SAMY KADOUS MEDIA CO. attends as scheduled, the booking will be considered performed with respect to the photographer's reserved time and availability.

    No refund will be automatically provided because an athlete fails to attend when the absence was not communicated within the applicable cancellation period.

    31. Client Responsibilities

    The Client is responsible for:

    • Providing accurate event information

    • Providing timely notice of schedule changes

    • Confirming that outside photography is permitted

    • Obtaining required venue or team authorization

    • Paying applicable access and travel expenses

    • Ensuring that the requested athlete is participating when applicable

    • Communicating relevant restrictions before the event

    • Providing reasonable cooperation necessary for the photographer to perform the service

    SAMY KADOUS MEDIA CO. is not responsible for issues caused by information the Client failed to provide or provided incorrectly.

    32. Force Majeure

    SAMY KADOUS MEDIA CO. will not be considered in breach of these Terms when performance is prevented or materially affected by circumstances beyond the photographer's reasonable control.

    Such circumstances may include severe weather, natural disasters, venue closures, government restrictions, transportation disruptions, emergencies, illness, injury, mandatory evacuation, event cancellation, or other conditions that make coverage unsafe or impractical.

    When reasonably possible, SAMY KADOUS MEDIA CO. will attempt to reschedule affected coverage or determine an appropriate resolution based on the circumstances.

    33. Limitation of Responsibility

    The Client acknowledges that sports photography is dependent upon conditions outside the photographer's control.

    SAMY KADOUS MEDIA CO. does not guarantee any particular photograph, play, athlete performance, playing time, shooting position, weather condition, venue access, or number of delivered images.

    Nothing in these Terms is intended to exclude any responsibility that cannot legally be excluded or limited under applicable law.

    To the maximum extent permitted by applicable law, the photographer's liability arising from the photography service will be limited to the amount paid by the Client for the affected service.

    34. Minors

    Many sports photography Clients may be under the age of 18.

    When required, a parent or legal guardian must authorize the booking and accept applicable Terms on behalf of a minor Client.

    SAMY KADOUS MEDIA CO. may request parent or legal guardian contact information or authorization when appropriate.

    35. Changes to These Terms

    SAMY KADOUS MEDIA CO. may update these Terms from time to time.

    The Terms applicable to a booking are generally the Terms presented to the Client at the time of booking.

    Changes to these Terms will not retroactively modify a confirmed booking unless required by law or otherwise agreed upon by the parties.

    36. Governing Law

    These Terms are intended to be governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, to the extent permitted by applicable law.

    37. Acceptance of Terms

    By submitting payment for sports photography coverage, the Client acknowledges that they have read, understood, and agreed to these Sports Game Action Photography Terms & Conditions.

    Payment confirms the booking and reserves SAMY KADOUS MEDIA CO.'s availability for the specified event.

    These Other Photography Services Terms & Conditions ("Terms") establish the policies and conditions applicable to photography services that are not specifically covered under the Senior Photography Session or Sports Game Action Coverage Terms.

    By requesting, scheduling, or booking a photography service and submitting the required payment, the Client acknowledges that they have had an opportunity to review these Terms and agrees to be bound by them.

    These Terms are intended to provide clear expectations regarding pricing, payment, scheduling, cancellation, rescheduling, travel, locations, image delivery, copyright, and other matters relating to photography services.

    1. Services and Pricing

    Photography services covered under these Terms may include, but are not limited to, events, weddings, family portraits, couples photography, creative portraits, commercial photography, and other photography projects.

    Pricing is determined on a project-by-project basis based on factors including the type of photography, duration, location, number of subjects, equipment requirements, editing requirements, requested deliverables, and other project-specific considerations.

    The specific services, coverage period, number of delivered images, deliverables, and other inclusions will be communicated to the Client before booking.

    Pricing and service details may vary between projects. Any pricing changes will not affect a booking that has already been confirmed unless otherwise agreed upon in writing.

    2. Booking and Reservation

    A photography service is not considered reserved until the required payment and/or retainer has been received and the booking has been confirmed by SAMY KADOUS MEDIA CO.

    A request, inquiry, or discussion regarding a particular date does not guarantee availability or reserve that date.

    Once a booking has been confirmed, the agreed-upon date and time are reserved specifically for the Client.

    3. Payment

    Payment requirements will be communicated to the Client before booking and may vary depending on the type and scope of the project.

    Unless otherwise agreed upon in writing, all required payments must be received by the stated deadline.

    SAMY KADOUS MEDIA CO. is not required to begin or complete a service for which the required payment has not been received.

    Accepted payment methods may include cash, Venmo, credit or debit card, or other payment methods made available by SAMY KADOUS MEDIA CO.

    4. Scope of Services

    The Client and SAMY KADOUS MEDIA CO. will agree upon the expected scope of the photography service before booking.

    Services or deliverables that are not specifically included in the agreed-upon scope may be subject to additional charges.

    Additional coverage time, locations, subjects, editing, deliverables, travel, or other requested services may require additional payment.

    5. Cancellation by Client

    If the Client chooses to cancel a scheduled service, any applicable non-refundable payment or retainer will not be refunded.

    Cancellation includes, but is not limited to, cancellation due to scheduling conflicts, changes in plans, personal circumstances, transportation issues, or any other reason initiated by the Client.

    If the Client has paid amounts in addition to a non-refundable retainer, SAMY KADOUS MEDIA CO. will determine whether those additional amounts are refundable based on the circumstances and timing of the cancellation.

    The Client should contact SAMY KADOUS MEDIA CO. as soon as possible if they need to cancel a booking.

    6. Rescheduling by Client

    The Client may request to reschedule a service, subject to the availability of SAMY KADOUS MEDIA CO.

    Rescheduling is not guaranteed and may be subject to additional fees depending on the timing and circumstances of the request.

    A request made shortly before the scheduled service may be treated as a cancellation.

    Any rescheduling limitations or specific rescheduling terms established in a project-specific agreement will govern that booking.

    7. Weather and Uncontrollable Circumstances

    For outdoor photography, weather conditions may affect the ability to safely and reasonably conduct the service.

    SAMY KADOUS MEDIA CO. may determine that a service should be postponed or rescheduled because of rain, thunderstorms, lightning, excessive wind, extreme temperatures, unsafe travel conditions, or other circumstances that could negatively affect safety or the quality of the service.

    Weather-related rescheduling initiated by SAMY KADOUS MEDIA CO. will not be treated as a Client cancellation.

    Other circumstances outside the photographer's reasonable control may affect the ability to provide the requested coverage or deliver specific images.

    8. Travel and Location Fees

    Travel requirements and any applicable travel fees will be communicated to the Client before the booking is finalized.

    The Client is responsible for location-specific costs unless otherwise agreed upon in writing.

    These costs may include admission, professional photography fees, permits, location rental fees, parking, reservations, photographer or vendor passes, facility fees, or other fees imposed by a property or venue.

    The Client is responsible for informing SAMY KADOUS MEDIA CO. of known location requirements before the service.

    If a location does not permit professional photography or requires an authorization that has not been obtained, SAMY KADOUS MEDIA CO. may decline to photograph at that location.

    9. Arrival and Punctuality

    The Client is expected to arrive at the agreed-upon location at or before the scheduled start time when applicable.

    The scheduled service begins at the agreed-upon start time regardless of when the Client arrives.

    Late arrival may reduce the amount of time available for photography. SAMY KADOUS MEDIA CO. is not required to extend the service beyond its scheduled end time because of a Client's late arrival.

    If a Client's late arrival makes the service impractical or impossible to complete, the service may be ended and any applicable payment may be forfeited.

    10. Client and Guest Conduct

    The Client is responsible for their own conduct and the conduct of any guests they bring to the service.

    SAMY KADOUS MEDIA CO. reserves the right to end a service if the Client or a guest engages in behavior that is threatening, abusive, discriminatory, harassing, excessively disruptive, unsafe, or otherwise inappropriate.

    A service may also be ended if a Client or guest interferes with the photographer's ability to perform the agreed services or creates a safety risk to the Client, photographer, equipment, or another person.

    If a service is ended because of Client or guest conduct, the Client may be responsible for the full agreed-upon price and may not be entitled to a refund.

    11. Image Selection

    SAMY KADOUS MEDIA CO. retains discretion over the photographs selected for final delivery.

    Not every photograph taken during a service will be delivered to the Client.

    Images may be excluded from the final gallery because of technical issues, duplicates, test shots, unflattering expressions, closed eyes, focus issues, lighting issues, or other artistic or technical considerations.

    The Client does not receive every photograph taken during the service.

    12. Editing

    Final photographs will be edited according to the established style of SAMY KADOUS MEDIA CO.

    SAMY KADOUS MEDIA CO. retains artistic discretion regarding the final appearance of delivered photographs.

    Requests for extensive alterations, major body modifications, removal of permanent physical characteristics, replacement of backgrounds, changes to clothing, or other edits outside the photographer's normal editing process may be declined or may be subject to an additional fee if agreed upon in advance.

    13. RAW and Unedited Files

    RAW files, unedited files, rejected images, test images, and unfinished photographs are not provided to the Client.

    The Client will receive only the final edited photographs selected for delivery by SAMY KADOUS MEDIA CO.

    14. Image Delivery

    Final photographs will be delivered through an online gallery or other digital delivery method selected by SAMY KADOUS MEDIA CO.

    Delivery timelines will vary depending on the type and volume of the project and will be communicated to the Client before or after booking as appropriate.

    The Client is responsible for downloading and safely storing delivered photographs.

    SAMY KADOUS MEDIA CO. is not required to maintain permanent access to a Client's gallery or permanently archive delivered files.

    Clients are encouraged to maintain their own backup copies of delivered photographs.

    15. Personal and Commercial Use

    Unless otherwise agreed upon in writing, the Client receives a non-exclusive license to use final delivered photographs for the purposes specified in the applicable agreement.

    Personal-use rights may include downloading, storing, printing, and sharing photographs on personal social media accounts.

    Commercial use, resale, licensing, commercial distribution, or other uses outside the agreed-upon rights require written permission from SAMY KADOUS MEDIA CO.

    16. Copyright

    Copyright and ownership of the photographs remain with Samy Kadous / SAMY KADOUS MEDIA CO. unless copyright ownership is specifically transferred through a separate written agreement.

    Payment for photography services does not transfer copyright ownership to the Client.

    17. Portfolio and Promotional Use

    SAMY KADOUS MEDIA CO. may request permission from the Client to use photographs from a service for portfolio, website, social media, advertising, promotional materials, competitions, or other business-related purposes.

    Permission may be requested separately from the booking process.

    The Client may decline permission for promotional use.

    Declining promotional use will not affect the Client's service, pricing, or access to delivered photographs.

    18. Personal Property

    The Client is responsible for personal belongings brought to the photography service, including clothing, accessories, phones, bags, vehicles, and other property.

    SAMY KADOUS MEDIA CO. is not responsible for lost, stolen, or damaged personal property.

    19. Project-Specific Agreements

    Because photography services covered by these Terms may vary significantly, additional terms may be included in the individual quote, invoice, contract, or written agreement for a specific project.

    If a project-specific agreement contains terms that differ from these general Terms, the project-specific agreement will govern that booking.

    20. Acceptance

    By submitting the required payment and booking a photography service with SAMY KADOUS MEDIA CO., the Client acknowledges that they have read, understood, and agreed to these Other Photography Services Terms & Conditions.

    The Client's payment and confirmation of the booking constitutes acceptance of the policies applicable to their service.
